EU: The AI Omnibus changed high-risk implementation dates

Status: In force since July 27, 2026.

The AI Omnibus postponed requirements for Annex III high-risk systems to December 2, 2027, and for high-risk AI embedded in Annex I regulated products to August 2, 2028. It also expanded certain AI Office oversight powers and adjusted administrative and AI-literacy requirements. European Commission summary and legislative link.

WHY IT MATTERS

The postponement changes compliance sequencing, but it is not permission to suspend governance. Boards should distinguish between:

  • A later statutory compliance deadline
  • Risks already present when AI influences employment, access, safety, rights, or consequential organizational decisions

Decision authority, human oversight, traceability, vendor controls, and incident escalation remain necessary even where a particular high-risk requirement has been deferred.

PRACTICAL EXECUTIVE GUIDANCE

Revise outdated AI Act implementation calendars, but preserve the governance work. Use the additional time for controlled testing, documented accountability, process-owner designation, and evidence that human reviewers possess both real authority and enough information to challenge AI outputs.

Hype filter: The operative development is not that the EU has “regulated all AI.” The substantive change is narrower: enforcement and specified transparency duties are active, while defined high-risk deadlines have moved. Executives should govern according to the actual system, role, use case, and applicable obligation, not generalized claims about the AI Act.
